FDR maintains cigarette prices under the NRA codes in this January 1935 letter, just four months before the Supreme Court struck down the NRA as unconstitutional. He tells Cullman that the NRA has extended cigarette price controls “for retail and wholesale cigarettes” until March 30, 1935. “In the meantime, provision is made for giving consideration to a plan to prevent destructive price cutting with its injurious effect upon small enterprises.
