EARP, WYATT. Autograph endorsement signed ("W.S. Earp"), as constable of Lamar, Missouri, consisting of 5 lines and signature plus docket (some 48 words in all), on back of a partly printed judicial summons issued by M. Pyle, Justice of the Peace, Lamar, Missouri, 26 September 1870. 2 pages, oblong 8vo, 136 x 218 mm. (5 x 8./8 in.), right-hand edge a bit worn and neatly restored, accomplished in several hands in blue and brown ink. WYATT EARP, FRONTIER SHERIFF A very early document relating to the notorious lawman. The subpeona--to be served by Earp as sheriff--summons various witnesses who are to appear "all excuses and delays set aside" the following day "to testify on the trial of a case, wherein the State of Missouri is plaintiff, and Eliajah Wills is defendant...and of this you are not to fail at your peril." On the verso, Earp writes: "I have served the within Suppeona [ sic ] upon the within named [a list of 10 names follows]...reading the same to them this Sept.27th 1870 Fees $6.00." (The writing in upper portion of the endorsement is much heavier than the following part, as if the ink in Earp's pen had begun to run out, the signature is consequently a bit light.) The docket, also in Earp's hand, reads: "Supbeona [ sic ] State of Missouri vs. Elijah Wills Court Fees $6.00." Documents signed or written by Earp are VERY RARE.
