ADDENDUM TO MITCHELL’S CONTRACT WITH SELZNICK INTERNATIONAL TO FILM “GONE WITH THE WIND.” Typed Carbon Signed (“Margaret Mitchell Marsh”) and Initialed, 3 pp, 4to, Atlanta, GA, February 14, 1940, being an agreement between Mitchell and Selznick International and Loew’s Incorporated regarding the copyright of film stills included in the “Motion Picture Edition” of Gone With the Wind, leaves lightly creased and smudged, signature bold. With copy of "Motion Picture Edition" in yellow printed wraps. An interesting addendum to Mitchell’s original agreement with Selznick International for the film rights to her landmark novel. Though David O. Selznick’s independent production company struck the original bargain with Mitchell to make the film version, in 1938 Selznick was forced to strike a profit-sharing deal with his father-in-law Louis B. Mayer of M-G-M/ Loew’s for the loan of Clark Gable. In this amendment, Mitchell signs and agreement with both Selznick International and Loew’s assigning copyright responsibilities going forward. In part: “Under the provisions of the contract between you and Selznick International Pictures, Inc. dated July 30, 1936 … relating to the motion picture rights and certain additional rights in your book entitled ‘Gone With the Wind,’ you assumed certain obligations in regard to the copyright status of the book in the United States and other countries, all as set forth in said contract. Selznick International Pictures, Inc. has heretofore assigned to Loew’s Incorporated an interest in said contract. / We have heretofore granted to the Macmillan Company permission to include in a so-called ‘motion picture edition’ of the book certain illustrations consisting of ‘stills’ taken from or produced in connection with the motion picture … and The Macmillan Company has published such motion picture edition containing such illustrations.” The document goes on to outline the points that, although Mitchell is still responsible for maintaining the copyright on the text of her novel, she is not responsible for maintaining or protecting the copyright of the stills from the film. Documents signed by Mitchell referring to the publication or filming of her work are exceedingly rare and highly desirable. See illustration.
